Thank you for using Medicine Order Delivery Service (hereinafter referred to as "MODS"). We aim to provide you with a seamless and effective way of ordering your prescription and delivering it to you. These terms and conditions explain your rights and responsibilities in using MODS.
MODS is an internet platform (website and mobile applications) operated by MIH Pte Ltd (hereinafter referred to as the "Vendor") . These terms and conditions, together with the Privacy Policy, constitute an agreement between you and the Vendor as a registered and non-registered user.
PLEASE READ THESE TERMS CAREFULLY. BY USING THESE SERVICES AND/OR REGISTERING WITH US, YOU AGREE TO THE TERMS OF THIS AGREEMENT, INCLUDING THE INFORMATION PRACTICES DISCLOSED IN OUR PRIVACY POLICY. IF YOU DISAGREE WITH ANY OF THESE TERMS, PLEASE DO NOT USE THIS PLATFORM OR ITS SERVICES. IF YOU ORIGINALLY AGREE TO THESE TERMS BUT SUBSEQUENTLY DECIDE TO WITHDRAW YOUR AGREEMENT.
We reserve the right to amend any of these terms and conditions at any time at our discretion. We will inform you of any revisions by a notification posted on this website with the effective date. Your continued use of our platform and services constitutes your acceptance of the revised terms and conditions.
USE OF THE MOBILE PLATFORM
Permitted Use Policy
The Platform, operated by the Vendor, provides an online prescription medication ordering and appointment booking with clinics registered with MODS, which includes an e-commerce transaction, an appointment booking service and advertisements for Merchants. As a condition of your use of the Platform, you agree that:
- You are an individual and are at least 18 years of age;
- You have the authority and capacity to enter into a binding legal obligation;
- Your use of the Platform will at all times comply with these Terms of Use;
- If you elect to create an account on the Platform:
- You may create only one account for your personal use;
- You may only make legitimate purchases for Services that comply with the letter; and
- You must safeguard your password and supervise the use of your account, and understand and agree that you are responsible for your own use and the use of your account by anyone you allow to access it;
- You represent that you are the authorised owner and signatory of any payment facilitation service and/or credit or charge card provided to us to pay the Agreed Price;
- You represent that you have the right to provide any and all information you submit to the Platform, that the information is only about yourself, and that all such information is accurate, true, current and complete;
- If you are accessing the Platform in Singapore and/or are subject to the provisions of the Personal Data Protection Act 2012 (Act 26 of 2012) of Singapore (the "PDPA"), you agree that the Vendor is authorised to collect, use and/or disclose any personal data (as defined in the PDPA) concerning you which may be provided by you in accordance with the purposes set out in these Terms of Use and in our Privacy Policy (as may be updated and posted on the Platform from time to time), and consent to such collection, use and/or disclosure;
Advertisements
Our Platform may carry advertisements (“Advertisements”) related to medical products and services. All information associated with an Advertisement is provided by the Advertiser. We do not in any way endorse any Advertisement. You are solely responsible for accessing Advertisements and any reliance you may place on such Advertisements is done solely at your own risk. We take no responsibility and assume no liability for any Advertisement on nor for the accuracy of any information contained therein or associated therewith. Your dealings or communications with Advertisers, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such Advertisers. We are not responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of Advertisements appearing on this Web Site.
Electronic Appointments
This Platform also provides the means for medical clinics to accept bookings for appointments from registered users/patients. The clinic alone is responsible for honouring any appointment(s). Your dealings or communications with the clinic(s) are solely between you and such Clinics.
Prescription Ordering
MODS is also a mobile Platform that allows you to order your prescriptions online and make the payment after the clinic confirms the medicine you want is available and correct. You must visit your doctor’s clinic at least once (or as per your Doctor’s advice) so that the doctor can prescribe the correct medication(s) for your condition. Thereafter, the Clinic can register with the platform and upload the medications in your MODS profile. Once uploaded you will be able to order through the platform.
Information you provide in MODS must be accurate and relate to yourself. Additionally, you agree to update and maintain such information on MODS to ensure that it is true, accurate, current and complete at all times.
Healthcare professionals on MODS are not employees of MODS. Any opinions, advice or information expressed by such individuals are those of the individual and the individual alone and they do not reflect the opinions of MODS. MODS does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned on MOD. The inclusion of healthcare professionals on MODS or in any professional directory on MOD does not imply recommendation or endorsement of such professional nor is such information intended as a tool for verifying the credentials, qualifications, or abilities of any professional contained therein.
Delivery Policy
Delivery charge applies. Packages requested to be left on the doorstep will be the responsibility of the Patient.
Cancellation and Refund Policy
During the ordering process, the Clinics will provide you with updated information on your ordered medications. You can then decide if you want to proceed or not. If you decide not to order, then you may cancel the Order at this point.
If you decide to pay after reviewing the medications and payment is made for the Ordered Medicine(s) no refund is given.
For safety reasons, medications sold are non-refundable and non-exchangeable. There is no charge for making or canceling e-appointments.
Third Parties
Our Platform may contain links to third-party Web sites ("Third-Party Sites") and third-party content ("Third-Party Content") as a service to those interested in this information. You use links to Third-Party Sites, and any Third-Party Content therein, at your own risk. We do not monitor or have any control over, and make no claim or representation regarding, Third-Party Content or Third-Party Sites. We provide these links only as a convenience, and a link to a Third-Party Site or Third-Party Content does not imply our endorsement, adoption or sponsorship of, or affiliation with, such Third-Party Site or Third-Party Content.
Disclaimer
We do not recommend or endorse any Advertiser. If you rely on any information posted on our platform, you do so solely at your own risk.
We have no special relationship with or fiduciary duty to you. Your dealings or communications with, Advertisers, and any terms, conditions, warranties or representations associated with such dealings, are solely between you and such Advertiser, and we will not be responsible or liable for any loss, damage or injury which you may sustain arising from any services provided to you by Advertisers (or from any failure to provide services to you). You acknowledge that we have no control over, and no duty to take any action regarding: which users gain access to our platform; what content is posted by users on our platform; what content you access via our platform; what effects the content may have on you; how you may interpret or use the content; or what actions you may take as a result of having been exposed to the content. Our Platform may direct you to sites containing content that you may find offensive or inappropriate. We make no representations concerning any content contained in or accessed through our platform, and we will not be responsible or liable in any way for such content, and you hereby release us from all liability for your having acquired or accessed content through or via this Web Site.
Our Platform and all associated services and content are provided on an "as is" basis, without warranties of any kind, either express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose or non-infringement.
Limitation of Liability
You waive and agree not to assert any claims or allegations of any nature whatsoever against us arising out of or in any way relating to your use of our platform and all associated services, the content or the materials contained in or accessible through our platform, including, without limitation, any claims or allegations relating to the alleged infringement of proprietary rights, alleged inaccuracy of content, or allegations that we have or should indemnify, defend or hold you harmless from any claim or allegation arising from your use or other exploitation of our platform. You use our platform at your own risk.
Without limitation of the foregoing, we shall not be liable for any loss of profits, loss of use, or other economic loss or any damages of any kind, whether direct, indirect, special, consequential, punitive or otherwise, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of our platform, the services, the content or the materials contained in or accessible through our platform, including without limitation any damages caused by or resulting from your reliance on any content or other information obtained from or accessible via our platform. If, notwithstanding the foregoing, we incur any liability which cannot be excluded by law, our aggregate liability, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of the site shall not exceed one hundred Singapore Dollars.
Notifications
As part of the services provided, we will send you notifications and/or emails reminding on actions to be taken - for registrations, ordering and prescriptions through the MODS.
Indemnity
You will indemnify and hold us harmless from any claim or demand made by any third party due to or arising out of your use of our Platform and the breach of any of the terms herein, or the infringement of any intellectual property or other right of any person or entity in connection therewith.
Storing credit card information
Your credit card information and other financial data needed to process your payment are collected, encrypted and stored by our third party payment processor, Stripe. Stripe is an online payment service provider which is certified to be a PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry. Please visit https://stripe.com/docs/security/stripe if you want to understand the security measures Stripe employs. Apps that work with Stripe include industry leaders like Adidas, Grab, Shopify, The Guardian and Unicef.
Storing of personal information
The vendor shall take commercially reasonable steps to safeguard the data you provide or we collect during your interaction with MODS and shall not have any responsibility in connection with any unauthorised access, use or transactions of these data.
MODS may store and use your data on its servers for purposes including, without limitation, the review of the performance, feedback and/or functionality of the MODS platform, and the carrying out of data analytics in connection with provision of MODS subject to the confidentiality and other provisions contained in this agreement.
Miscellaneous
These Terms of Use may change. Because your use of MODS means you agree to these Terms of Use, if we revise and update these Terms of Use, your continued use of MODS will mean that you accept those changes. You choose whether or not you use MaNaDr. If you do not agree to all of these Terms of Use, please do not use MODS.
You are responsible for your account. Accurate and complete registration information is required to use MODS. You are responsible for the security of your passwords and for any use of your account. Please immediately notify us of any unauthorised use of your password or account. Allowing any other person or entity to use your identity for posting on or using MODS is not permitted.
You agree to use the Platform and any Service responsibly, and in a manner that is not: unlawful, threatening, harassing, abusive, defamatory, slanderous, libellous, harmful to minors, vulgar, gratuitously violent, obscene, pornographic, indecent, lewd, invasive of another's privacy, or racially, ethnically or otherwise offensive, hateful or abusive.
The Vendor has no editorial control over or responsibility for Content provided by third parties and any opinions, statements, products, services or other information expressed or made available by third parties (including healthcare professionals) or users on MODS are those of such third parties or users. We make no representations about the accuracy or reliability of any opinion, statement or other information provided by any third party, and do not represent or warrant that your use of the Content displayed or referenced on MODS will not infringe rights of third parties not owned by or affiliated with the Vendor.
You agree that MODS may send you automatically via e-mail, mobile telephone or other contact information provided by you in your account settings, content including but not limited to, reminders relating to registration, ordering, appointments and prescriptions for you.
You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. You authorise MODS to immediately invoice your credit card or other payment account provided for all fees and charges due and payable and agree that no additional notice or consent is required.
MODS recognizes your privacy and, in accordance with our Privacy Policy Statement, will not release information to anyone without your written authorization or as required by law.
You understand and agree that we are not responsible for the data bandwidth, signal strength, or internet or data connectivity of your mobile device or computer.
These Terms of Use may change. Because your use of MODS means you agree to these Terms of Use, if we revise and update these Terms of Use, your continued use of MODS will mean that you accept those changes. You choose whether or not you use MODS. If you do not agree to all of these Terms of Use, please do not use MODS.
